Germany’s Constitutional Court puts the brakes on the federal government’s ability to monitor it’s internal threats, thanks to class action lawsuits. Sound familiar?
Germany’s highest court has dramatically limited the scope of a German data-collection law which politicians said would help prevent terrorist attacks.
The law gave the federal government broad access to stored telephone and internet data — including e-mail addresses, length of call and numbers dialled — for a six-month period. In the case of cell phone calls, service providers could potentially save data on the location calls were made from.
The law went into effect in January. But on Wednesday the German Constitutional Court in Karlsruhe issued an injunction against it, declaring parts of the law unconstitutional pending further review. Full story from Spiegel Online…

House Passes FISA Amendments Act

The House has just passed the House amendment to the Senate amendment to H.R. 3773, to amend the Foreign Intelligence Surveillance Act of 1978 to establish a procedure for authorizing certain acquisitions of foreign intelligence, and for other purposes, by a vote of 213-197-1. The revised House legislation to amend FISA grants new authorities for conducting electronic surveillance against foreign targets while preserving the requirement that the government obtain an individualized FISA court order, based on probable cause, when targeting Americans at home or abroad. The House bill also strongly enhances oversight of the Administration’s surveillance activities. Finally, the House bill does not provide retroactive immunity for telecom companies but allows the courts to determine whether lawsuits should proceed.

President Bush once again show’s the traitors in Congress what he’s made of, the right stuff! Saturday he sent the white flag bearing Dhim(S) packing with their tail between their legs after another attempt to not only hobble our CIA and other war fighters, but as Ed Morrisey at Hot Air puts it;
it is wildly inappropriate to publish the limits of interrogatory technique for the CIA. That should be left to the imagination of our enemie, again for two reasons. One, the publication allows our enemies to prepare themselves for the limit of the techniques published, making successful interrogation much more difficult to achieve. Second, having the limits remain unknown allows fear of what might happen to make less-intensive techniques more effective.

The last two weeks I have written about how Speaker Nancy Pelosi (D.-Calif.) and the House Majority’s left-wing leadership decided to go on a 12-day vacation instead of renewing legislation that allowed our Intelligence agencies to easily monitor the communications of terrorists overseas. As a result, the legislation expired, crippling our intelligence gathering efforts.
I wrote, "This abdication of responsibility by such a high-ranking member of our government has been the most amazing anti-national security action by Congress in decades." Judging by the e-mails and comments I received, many of you agreed.
It turns out we are not the only ones. Not by a long shot.
If there were ever a more glaring example of the liberal syphilis infecting the Democrat(S) party, it’s the hard headed opposition to FISA by the Pelosi led House socialist. They would have their mislead faithful believe that they are opposing the bill out of principled protection of the constitution. Puhlease…
So let’s take a closer look at the real reason Pelosi and her band of socialist, blame America for everything, group of hacks are throwing American security to the wind under the guise of principles. It’s not about protecting the constitution, it’s not even about a sense of patriotism, it’s a cold calculated move for the trial lawyers that line their pockets. You see, so far as I can tell, the FISA act, among many other things, would protect the telecom companies from class action ambulance chasers. If FISA goes through as written, the lawyers stand to lose hundreds of millions, if not billions in potential class action lawsuits. How does that affect the San Francisco nut job and her flunkeys? They don’t get money!

Terrorists Still Have the Advantage
America, by the inaction of the U.S. House of Representatives, has been weakened substantially in fighting terrorism.
As I reported last week, Speaker Nancy Pelosi (D.-Calif.) and her left-wing allies decided to leave Washington without voting on the bipartisan Senate bill that would have extended key provisions of the Protect America Act, a bill that is essential for America’s ability to quickly and deftly track terrorist communications overseas.
This abdication of responsibility by such a high-ranking member of our government has been the most amazing anti-national security action by Congress in decades.

It’s hard to think of an action that has put as many lives at risk as House Speaker Nancy Pelosi’s (D.-Calif.) declaration of unilateral disarmament in the War on Terror last week.
By refusing to renew our ability to monitor terrorist communications overseas, Speaker Pelosi has put Americans at risk. She has blinded our counterterrorism capability and shut down America’s most sophisticated defenses against the irreconcilable wing of Islam. As of midnight last Saturday, the law governing America’s defense is totally inadequate to stop terrorists.
Why? Because the Democratic left believes lining the pockets of trial lawyers is more important than stopping terrorists.
